Generally, the first employment based preference category (EB-1) is reserved for the those considered to have reached the very top of their field of endeavor, including the arts (visual and performing), sciences, education, business or athletics. 

There are 3 types of EB-1 petitions:


  • Aliens of Extraordinary Ability.
  • Outstanding Researchers and Professors, and
  • International Intercompany Transferees.


With respect to aliens of extraordinary ability, no offer of employment is necessary.


So individuals who believe that they meet the criteria for eligibility to file a petition can self-sponsor.  This is often an important consideration for those wishing to apply because they do have to rely on an employer to sponsor the petition, which gives the applicant a certain freedom that is not available in any other immigrant visa category.


The greatest advantage to each of these visa categories is that there is no requirement of an approved labor certification (PERM application.)  As noted in our section on labor certifications, the process to procure a certified PERM application from the U.S. Department of Labor is a lengthy, expensive and sometimes arduous process, depending on the occupation and the qualifying criteria of the employment position. 



There is very rarely a backlog in immigrant visa numbers available in the EB-1 categories.


These are the prominent reasons why those eligible would prefer to use these categories, if at all possible.
